Description and Acceptance of Services

FinFiber provides users with access to information and facilitation services related to a range of financial products and services offered by banks, non-banking financial companies (NBFCs), and other regulated financial institutions (collectively referred to as “Services”).

The Company may also enable users to interact with certain external service providers, including services such as credit information retrieval, eligibility evaluation, and other third-party platform-based services (including banking and financial institution websites), which may be required during the process of availing or exploring the Services (“Ancillary Services”).

All Services and Ancillary Services are offered on a best-effort commercial basis, and by choosing to use them, you acknowledge that your participation is completely voluntary and based on your own consent and decision.

By continuing to access or use the Services and Ancillary Services, you agree that these Terms of Use, along with any future amendments or updates, shall remain applicable to you until formally terminated as per the Agreement.

You further consent to receive communications from FinFiber, its business partners, service providers, and authorized third parties through SMS, email, and phone calls, which may include service updates, informational alerts, and promotional content.

You acknowledge and agree that such communications may be sent to the contact details provided by you, including mobile numbers registered under the Do Not Disturb (DND/NCPR) registry, subject to applicable regulatory permissions under TRAI guidelines.

The Company shall have the right to store, process, and use your information as required for legal compliance, dispute resolution, and enforcement of its agreements related to the Services and Ancillary Services.

Eligibility

You hereby represent and confirm that you are a resident of India, are at least 18 (Eighteen) years of age, and are competent to enter into a legally binding contract under the Indian Contract Act, 1872 for the purpose of accessing and using the Services offered by the Company.

Registration / Account

By registering and using this Website, you confirm that you are legally permitted to enter into a binding agreement and are not prohibited from receiving services under any applicable law in India or other relevant jurisdictions. Your use of the Website must be strictly for lawful purposes and for accessing services made available through the platform.

Access to your account is secured through credentials such as your login ID and password, which you are responsible for maintaining in strict confidence. These credentials, along with your registered mobile number and other provided details, constitute your Registration Information and must be protected by you at all times.

In the event of any unauthorized access or suspected breach of security, you must promptly notify FinFiber. The Company will not be held responsible for unauthorized usage of your account unless it is directly proven to have resulted from the Company's negligence or fault.

You are required to provide accurate, complete, and up-to-date information during registration and maintain its accuracy throughout your use of the Website. Any attempt to provide false identity information or gain unauthorized access to the platform is strictly prohibited.

Where applicable, certain services may be governed by additional terms and conditions, which you agree to review and comply with before using such services.

Customer Information Sharing for Verification

The information provided by users on the Website may be shared with banks, non-banking financial companies (NBFCs), and other regulated financial institutions (“Financial Partners”) for the purpose of processing requests for financial products and services.

The Company operates solely as a facilitator/marketplace platform and does not undertake any KYC verification, assessment, or approval processes. All verification, due diligence, and approval activities are carried out exclusively by the respective Financial Partners in accordance with their internal policies and applicable laws.

It is acknowledged that the information provided by users, including personal and financial details, may be used by the Financial Partners for identity verification, eligibility assessment, and processing of applications.

Users consent to the transfer and sharing of such information by the Company with Financial Partners for the purpose of enabling and facilitating the requested services.

Privacy Policy

By accessing and using the Website, users provide consent for the collection, use, and processing of their information in accordance with the Privacy Policy. This Privacy Policy governs the manner in which the Company handles and protects personal information when users access or interact with the Website and any ancillary services provided through the platform.

FinFiber acts strictly as an intermediary platform that connects users with third-party financial institutions, including lenders and credit card issuers. FinFiber does not verify, endorse, or guarantee the accuracy, completeness, or reliability of any information submitted by users on the Website. Any content provided by you is at your own risk.

You grant FinFiber a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive right to use, store, process, reproduce, modify, adapt, publish, and share such information with its partner financial institutions and service providers, strictly for the purpose of facilitating loan, credit card, and credit score-related services. FinFiber reserves the right to carry out additional verification checks for security or compliance purposes and may refuse or delay processing of any transaction where it is not satisfied with the authenticity or validity of the user or transaction.

FinFiber shall not be liable for any non-completion, non-processing, or failure of any payment transaction, nor for any damages, claims, or losses arising therefrom. All payment transactions, where applicable, shall be subject to the terms and conditions of the respective banks, payment service providers, and financial institutions, and FinFiber disclaims any liability arising from actions or decisions taken by such entities.

You agree to provide accurate and lawful payment information and confirm that any payment instrument used by you is valid and legally owned by you.

No information or communication provided by FinFiber shall be considered as a warranty or guarantee of any kind unless expressly stated.

Limitation of Liability

Notwithstanding anything stated above, if the Company is found liable for any proven and actual loss arising out of or in connection with the use of the Website or Services, the total liability of the Company shall be limited, in aggregate, to the service or transaction fees paid by you to the Company for the relevant transaction or service, if applicable.

Indemnity

During the existence of such events, the affected obligations shall be suspended to the extent and for the duration of the impact. Such inability or delay in performance shall not be considered a breach of obligations or result in any legal liability on the part of the Company.

These Terms of Use and the relationship between you and the Company shall be governed by the laws of India. In the event of any conflict between the laws of India and those of any other jurisdiction, the laws of India shall prevail. Any dispute, claim, or controversy arising out of or in connection with these Terms, including any issue relating to its breach or termination, shall be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996 and any applicable amendments.

The arbitration shall be conducted by a sole arbitrator appointed mutually by you and the Company. If such mutual appointment is not possible, the matter shall be referred to a panel of three arbitrators, where each party appoints one arbitrator and the third is appointed by the two appointed arbitrators. The venue of arbitration shall be in India, and the proceedings shall be conducted in the English language. The arbitral award shall be final and binding.

The Website is intended for use within India and shall not be used in any jurisdiction where such use would violate applicable laws or these Terms. Any dispute requiring judicial or quasi-judicial intervention shall be subject to the jurisdiction of the courts in India.

Failure by the Company to act upon any breach shall not be treated as a waiver of its right to act upon similar or subsequent breaches.
